R v AD EWCA Crim 454
This was an appeal against a Crown Court conviction at the Court of Appeal heard on 29th April 2016.
It related to a case where a prosecution counsel had drafted the Indictment incorrectly and put the wrong section of the statute under several of the counts - it had stated s.14 as opposed to s.15 of the Sexual Offences Act 1956. This had only been spotted by the ever sharp-eyed Registrar of Criminal Appeals and completely missed by both original counsel and unfortunately the trial judge.
After some considerable citation of caselaw their Lordships conculded that this was not in fact fatal to the safety of the convictions so the appeal against conviction was dismissed.
